The following terms and conditions (the “Terms and Conditions”) form a binding agreement (“Agreement”) between you and the Stratford Winter Film Festival (“SWFF”), and governs the access to, purchase and use of SWFF tickets for events and/or screenings. Your purchase and /or use of SWFF tickets indicates your acceptance of the following Terms and Conditions and your agreement to be bound by them. Any references to money amounts in this Agreement, unless otherwise specified, are in Canadian dollars.
- Times and locations of film screenings are subject to change at the discretion of event organizers.
- All sales are final. Refunds are not permitted. All service fees and taxes are included on ticket purchases. The resale of tickets is prohibited.
- Purchaser is responsible for checking the date, time and venue location on this ticket. Tickets are non-refundable and cannot be exchanged on or after the performance. All performances proceed as scheduled despite weather conditions and transportation delays.
- SWFF reserves the right, in its sole discretion, to refuse admission, expel from the premises, and/or seize or cancel the ticket, without refund, of any person who violates these Terms and Conditions or whose conduct is deemed objectionable, in SWFF’s sole discretion. Offending behaviour includes, but is not limited to, disorderly conduct, disruptive behaviour, physical or verbal abuse towards SWFF staff, and persistent disregard of SWFF policies.
- Cameras and recording / transmission devices are strictly prohibited during events and screenings. It is illegal to record or make a copy of a film without the permission of the copyright owner.
- All electronic devices must be silenced and stowed away during screenings. Bags may be subject to inspection.
- Due to venue fire codes, sitting in the aisles or standing at the back of the venue is not permitted.
- By the use of a ticket, the user indemnifies SWFF and its affiliates, and waives and releases SWFF from and against any and all claims, liabilities, expenses (including legal fees) and damages arising out of any claims they may have against SWFF for any breach by the user of these Terms and Conditions, and the loss, damage, injury, liability or expense they may suffer arising from or connected to their presence at the event venue due to any reason whatsoever, including those arising from or connected to personal injury, property loss/damage, invasion of privacy, defamation, or death, including, without limitation, any claims alleging facts that, if true, would constitute a breach by the user of these Terms and Conditions.
- SWFF may change these Terms and Conditions at any time without advance notice. Placing a ticket order after any changes are in effect shall mean that the Purchaser has accepted the changed Terms and Conditions.
- These Terms and Conditions and any other legal notices, policies, and guidelines of SWFF linked to or referenced in these Terms and Conditions constitute the entire Agreement between the Purchaser and SWFF relating to the purchase and use of SWFF tickets and supersedes any prior understandings or agreements (whether oral or written), claims, representations, and understandings of the parties regarding such subject matter. This Agreement may not be amended or modified except by SWFF making such amendments or modifications available on its website.
- SWFF, this website, and the content of this website (excluding linked web sites or content) are physically located within the Province of Ontario, Canada. This Agreement will be governed by the laws of the Province of Ontario and the federal laws of Canada, and shall be treated in all respects as an Ontario contract, without reference to the principles of conflicts of law. In the event of a dispute, the Purchaser and SWFF agree to submit to the non-exclusive jurisdiction of the Ontario courts. The Purchaser and SWFF expressly exclude the UN Convention on Contracts for the International Sale of Goods, and the International Sale of Goods Act (Ontario) as amended, replaced, or re-enacted from time to time. SWFF has required that this Agreement and all documents relating thereto be drawn-up in English.
- Any provision of this Agreement which is prohibited or unenforceable in any jurisdiction shall, as to that jurisdiction, be ineffective to the extent of such prohibition or unenforceability and shall otherwise be enforced to the maximum extent permitted by law, all without affecting the remaining provisions of this Agreement or affecting the validity or enforceability of such provision in any other jurisdiction.
- This Agreement shall enure to the benefit of and be binding upon the Purchaser and SWFF and each party’s respective successors and permitted assigns. Purchaser acknowledges having read this Agreement before accepting it, having the authority to accept this Agreement, and having received a copy of this Agreement.
